Terms of Service

1. Acceptance of Terms

By accessing or using the NABE-Fit mobile application and related services (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

NABE-Fit is operated by NABE — FROZEN LAB, located at Pertokoan Uluwatu Square, Jalan Uluwatu Raya No. 178, Jimbaran, Kuta Selatan, Badung — 80361, BALI, Indonesia (“we”, “our”, or “us”).

2. Description of Service

NABE-Fit is a trail tracking and fitness application designed for hikers in Bali, Indonesia. The Service provides:

• GPS-based trail navigation and activity recording on 10 locations in Bali.
• Health and fitness metrics including distance, elevation, pace, and calorie estimation.
• Community features such as activity feeds, leaderboards, groups, and challenges.
• Safety features including emergency SOS, live location sharing, and weather alerts.
• Offline map downloads for use in areas without internet connectivity.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain and promptly update your account information.
• Keep your password secure and not share it with others.
• Accept responsibility for all activities that occur under your account.
• Be at least 13 years of age. Users under 13 are not permitted to use the Service.

4. User Conduct

When using NABE-Fit, you agree not to:

• Upload false, misleading, or fraudulent activity data.
• Use the Service for any illegal or unauthorized purpose.
• Harass, abuse, or harm other users through community features.
• Attempt to gain unauthorized access to other users' accounts or data.
• Interfere with or disrupt the Service or its infrastructure.
• Use automated means (bots, scrapers) to access or collect data from the Service.

5. Safety & Assumption of Risk

⚠️ HIKING AND OUTDOOR ACTIVITIES INVOLVE INHERENT RISKS.

NABE-Fit provides navigation tools, trail information, and safety features as aids only. The Service is not a substitute for proper preparation, equipment, training, or professional guidance. You acknowledge that:

• GPS accuracy may vary and should not be solely relied upon for navigation.
• Weather conditions can change rapidly and may not be reflected in real-time data.
• Trail conditions may differ from the information provided in the app.
• The SOS feature depends on network connectivity and third-party services beyond our control.
• You are solely responsible for your safety and the safety of those hiking with you.

By using the Service, you voluntarily assume all risks associated with hiking and outdoor activities, including but not limited to injury, illness, property damage, or death.

6. Intellectual Property

The NABE-Fit name, logo, app design, and all original content are the intellectual property of NABE — FROZEN LAB. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

Trail data, GPX routes, and mountain information provided through the Service are licensed for personal, non-commercial use only. Redistribution of this data is prohibited.

7. User-Generated Content

By uploading or sharing content through the Service (including activity data, photos, and profile information), you grant us a non-exclusive, royalty-free license to display and distribute that content within the Service. You retain ownership of your content.

You are responsible for ensuring that any content you share does not infringe on the rights of third parties or violate applicable laws.

8. Limitation of Liability

To the maximum extent permitted by Indonesian law, NABE — FROZEN LAB shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to:

• Personal injury or death during hiking activities.
• Loss of data or interruption of service.
• Inaccurate GPS, weather, or trail information.
• Failure of emergency or safety features due to network conditions.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.

9. Termination

We reserve the right to suspend or terminate your account at any time, without prior notice, if you violate these Terms or engage in conduct that we deem harmful to the Service or its users.

You may delete your account at any time through the app settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

10. Third-Party Services

The Service integrates with third-party platforms including Google (OAuth authentication, Maps), OpenWeatherMap (weather data), and MapLibre (map rendering). Your use of these integrated services is subject to their respective terms and privacy policies.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through the app. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Badung, Bali, Indonesia.
